Theme: The Imperfect Complainant - Navigating the Grey Areas in a POSH Inquiry
In some PoSH inquiries, the Complainant's actions and demeanor can make the IC doubt the veracity of the actual complaint. While most Complainants may appear distressed, and will have clearly tried to draw a boundary with the Respondent prior to approaching the IC, there are also cases where this element does not exist, and the Complainant almost appears complicit in the actions of the Respondent. How does the IC navigate such cases in a fair and objective manner, while also ensuring that there is no miscarriage of justice?
