IC Orientation: Understanding Jurisdiction and Redressal Process under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013

For the IC to conduct an inquiry, it first needs to ascertain whether a complaint falls within its ambit or not. In this session, we will discuss how the IC can ascertain jurisdiction and the steps that it should take thereafter.
Contents of Part I: 19th January 2023- 11 am to 1 pm
1. Types of workplace misconduct and harassment
2. Sexual or non-sexual?
3. Elements needed for IC to have jurisdiction: Employment status of parties, gender of parties, workplace and manner of complaint.
Contents of Part II: 20th January 2023- 11 am to 1 pm
4. Understanding who has jurisdiction through case scenarios
5. Redressal Process - Conciliation v Inquiry
6. Factors determining recommendations of the IC
Who should attend?
Employees, HR, IC members, anyone interested in understanding how an incident can be termed as sexual harassment at the workplace, and when and how the IC can handle such a complaint.
