Greetings from SASHA. Announcing the 41st SASHA Workshop in the Compliance & Beyond Series.
Theme:
The importance (and art) of documentation and report writing in POSH inquiries.
The IC is required (as per the POSH Act) to share its findings with the Complainant and Respondent to provide them with an opportunity to argue against these findings. Following this, the IC must provide a copy of its Findings Report containing recommendations for action, to the Employer, which they must then implement. An appeal against these recommendations lies with the Court or Tribunal of appropriate jurisdiction.
This report is therefore an important document that must not only mention the IC's findings and recommendations, but also describe the inquiry process, an analysis of the evidence based on which the IC arrived at its conclusion, as well as its reasoning. Join us to understand how to draft reports and related inquiry documentation that can stand scrutiny upon review.
